The European Court of Justice has just condemned the Luxembourg for having failed to establish an electronic national register for road transport companies.

The court has judged the Grand Duchy´s failure to intoduce an electionic national register which conforms to and is connected to those of other member states. In so doing, Luxembourg has not met its obligations under article 16 of the related regulation stated by the European Court of Justice, which establishes common norms to be respected in the sector of road transportation.

Luxembourg faces a first sentence without financial sanctions in the framework of a procedure for non-conformance.

The interconnection between national registers aims to have better control over access to the profession of road transport company managers as well as establishing the exchange of information between member states on infractions commited by such businesses.

As such, on 22 November 2016, the Luxembourg Parliament voted for a law involving the creation of this national electronic register for road transport companies which regulates the exchange and treatment of data at a judicial level.

On a technical level, the tests with European instances envisaged for the beginning of Spring 2017.
