As part of its "Enterprise Europe Network - Luxembourg" activities, the Luxembourg Chamber of Commerce, in collaboration with the clc, is hosting "Fit4Tenders", a conference on the appeals, litigation and competition rules applicable to public procurement on Wednesday 8 March. 

Representing about 18% of the EU's GDP, public procurement is a top economic opportunity for businesses. One of the main objectives of the 2014/24 / EU and 2014/25 / EU Directives is to reduce the administrative burdens faced by SMEs in particular. Regulatory updating aims to improve SMEs' access to public procurement by simplifying procurement procedures, while placing public procurement at the service of the European strategy for sustainable development, social inclusion and innovation.

In the context of public procurement, unsuccessful tenderers must be informed of the decision to award the contract and have the right to lodge an appeal, where appropriate. In this context, it is important to know the pitfalls to avoid. During his intervention, Mr. Sébastien Couvreur, partner at Krieger Associates, will address, among other things, the law governing temporary associations, complaints, administrative recourse, assignment and dispute settlement at the performance stage of the contract, including overview of sensitive situations, price revision, acceptance, final settlement, supplementary benefits, etc.

Occasionally, competing undertakings are required to submit joint offers, to form temporary associations or to use subcontractors. Very often, companies are unaware that certain consultations and exchanges of information prior to the submission of tenders can constitute serious violations of the competition rules. During his discussion, Mr. Gabriel Bleser, associate with Moyse Bleser, will give an overview of the competition rules to be observed when submitting tenders in order to avoid their cancellation and/or the initiation of infringement proceedings by the Competition Council.
