Due to new requirements, Luxembourg companies with 15 or more employees will need to appoint staff delegates next year.

As of 12 March 2019, companies that record at least 15 employees between 1 February 2018 and 31 January 2019 will ne required to appoint staff delegates ahead of the 2019 social elections.

The novelty of the upcoming social elections is the simplification and digitisation of certain administrative procedures that companies will have to make with the Labour and Mines Inspectorate (ITM). Companies will thus have to carry out the following administrative procedures online via MyGuichet.lu: announce elections on the modalities of organising social elections; announce the time limit for the lists of electors; communicate candidate data; declare the results of the electoral operations; declare the functions of the staff delegation.

The introduction of delegates on the MyGuichet.lu platform foresees the following benefits for companies: step-by-step guidance through the processes with screens that adapt according to the profile of the company; pre-prepared forms thanks to already-known data; automatic generation of documents required for social elections.

For its part, ITM is taking advantage of the digitalisation of exchanges in order to integrate faster and better data into its information system. It will thus be able to communicate more effectively on the results of social elections. All other administrative procedures relating to social elections must be carried out in accordance with the legal provisions or related regulations.
